Acceptance of Terms

By visiting the website Thought Coach, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to Thought Coach, you agree to be bound by the following Terms and Conditions of Service. If you do not want to be bound by our Terms your only option is not to visit, view or otherwise use the services of Thought Coach. You understand, agree and acknowledge that these Terms constitute a legally binding agreement between you and Thought Coach and that your use of Thought Coach shall indicate your conclusive acceptance of this agreement.

Provision of Services

Thought Coach is entitled to modify, improve or discontinue any of its services at its sole discretion and without notice to you even if it may result in you being prevented from accessing the services. Furthermore, you agree and acknowledge that Thought Coach is entitled to provide services to you through subsidiaries or affiliated entities.

Proprietary Rights

Thought Coach may contain proprietary and confidential information including trademarks, service marks and patents protected by intellectual property laws and international intellectual property treaties. Thought Coach authorizes you to view and make a single copy of portions of its content for offline, personal, non-commercial use. Our content may not be sold, reproduced, or distributed without our written permission. Any third-party trademarks, service marks and logos are the property of their respective owners. Any further rights not specifically granted herein are reserved.

Disclaimer of Warranties

Your use of Thought Coach is entirely at your own risk and that our services are provided “As Is” and “As Available”. Thought Coach does not make any express or implied warranties, endorsements or representations whatsoever as to the operation of the Thought Coach website, information, content, materials, or products. This shall include, but not be limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement, and warranties that access to or use of the service will be uninterrupted or error-free or that defects in the service will be corrected.

Limitation of Liability

Thought Coach and any of its subsidiaries or affiliates shall in no event be liable for any direct, indirect, incidental, consequential, or exemplary damages. This shall include, but not be limited to damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information or other intangible loss arising out of the use of or the inability to use the service, or information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information. The above limitation shall apply whether or not Thought Coach has been advised of or should have been aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed the liability of Thought Coach is limited to the greatest extent permitted by law.

External Content

Thought Coach may include hyperlinks to third-party content, advertising or websites. You acknowledge and agree that Thought Coach is not responsible for and does not endorse any advertising, products or resource available from such resources or websites.

Jurisdiction

You expressly understand and agree to submit to the personal and exclusive jurisdiction of the courts of the country, state, province or territory determined solely by Thought Coach to resolve any legal matter arising from this agreement or related to your use of Thought Coach. If the court of law having jurisdiction, rules that any provision of the agreement is invalid, then that provision will be removed from the Terms and the remaining Terms will continue to be valid.

Entire Agreement

These terms constitute the entire general agreement between you and Thought Coach. You may be subject to additional Terms and conditions when you use, purchase or access other services, affiliate services or third-party content or material.

Changes to the Terms

Thought Coach reserves the right to modify these Terms from time to time at our sole discretion and without any notice. Changes to our Terms become effective on the date they are posted and your continued use of Thought Coach after any changes to Terms will signify your agreement to be bound by them.

Thought Coach commits to protect your privacy online. You can visit our web site without disclosing any of your personal information. We ask you for personal information when necessary. Our visitors voluntarily provide information to this web site.

We gather routine website usage information, including page views, and browsing information. We collect details on a random, anonymous basis, which means no personal information links to the data.

This site contains hypertext links with other sites. Thought Coach has no control over the content or the availability of these websites, is not responsible for the privacy practices of those web sites. We offer the links for convenience and reference purposes only. We are not liable for any information or materials they contain.

In order to deliver services to you, your personal information may be disclosed to third party organisations. Your personal information is disclosed only in relation to providing services to you. Thought Coach partners with organisations that are legally bound by confidentiality and privacy obligations in relation to the protection of your personal information.

In addition, we may disclose your personal information to third parties when requested to do so by you. Thought Coach complies with all government and regulatory authorities and will disclose your private information if required to do so by law.

Ethics, Integrity and Transparency

As an ICF Accredited provider, our organization adheres to and emphasizes the International Coaching Federation Code of Ethics. The ICF Code of ethics describes the ICF core values, ethical principles, and standards of behavior for all ICF professionals. Meeting these ethical standards of behavior is the first of the ICF core coaching competencies. Additionally, Thought Coach commits to acting with integrity and transparency. We hold ourselves and our participants to the highest level of integrity and strive to be as transparent as possible by explicitly stating measures being taken to provide programs in an ethical manner. We do not believe in using manipulative or dishonest sales tactics and strive to provide a safe and ethical sales process. Further, we work to provide fair and equitable pricing for all programs to ensure access and quality of coaching education.

It is the policy of Thought Coach that:

Thought Coach seeks to ensure equitable treatment of every person and to attempt to solve any grievances in a timely and fair manner. Participants have the right to file a grievance regarding presentation or content, facility concerns, or instructor/faculty behavior. All grievances will be addressed to the best of our ability to prevent further problems. A process for filing grievances can be found below:

  1. A participant should first attempt to resolve the issue directly with the educator/trainer, staff, or participant with whom they have an issue. If participants are not comfortable approaching the individual, they can proceed to step 2.
  2. If participants are not comfortable approaching the individual with whom they have a grievance, or are unable to resolve the issue directly, participants should submit a written grievance to the Director of Education within 10 days. The Director of Education will review the issue and talk to the student within 10 days of receiving the complaint. The Director of Education will work with all parties involved to resolve the issue.
  3. All decisions made by the Director of Education regarding the complaint are final.

Education and Training Policies

Success in our program requires full commitment by all participants. By enrolling in this course, participants agree to being fully present during all sessions and participate to the best of their ability. This includes arriving on time, abiding by the code of conduct, and engaging in course activities.

Attendance

In order to provide you with the minimum required training hours for certification, it is important that you are present at all live virtual classroom sessions.

If you have an emergency or become ill and are not able to attend a coaching session, please contact your instructor immediately. You will be expected to complete the session materials, review the session recording, and complete a coaching session outside the live session to make up for the missed session. Additionally, you must write a short reflection of the recorded session and send it via email to your instructor.

If you need to miss more than 3 live virtual classroom sessions, you will have the option to work with the instructor to cover the missed material at your own expense. If you miss more than 2 hours of group mentor coaching, you will need to arrange for and pay for individual mentor coaching sessions to complete the required 10 hours of mentor coaching to satisfy the International Coaching federation requirements.

Course Engagement

Our courses are designed to be interactive and engaging for our participants. It is therefore an expectation that you participate in course activities, including dialogue with the course instructor and peers, mock coaching activities, and experiential learning exercises. If you are unable to participate in an activity, please inform your instructor as soon as possible. Please refer to the code of conduct for additional details.

Code of Conduct

Participants are expected to conduct themselves in a professional manner during all sessions. This includes, but is not limited to:

  • Arriving on time to all sessions.
  • Attending all live sessions and mentor coaching sessions.
  • Having your camera on for virtual live sessions.
  • Participating fully in all sessions and mentor coaching sessions. This includes being prepared for the session, involving yourself in discussions and activities, assuming responsibility for your learning, and contributing to the learning of others.
  • Engaging in discussions with integrity and honesty.
  • Being respectful of your fellow participants and instructors, including silencing your phone, not texting, and other disruptive behaviors.
  • Embracing diversity and inclusion while respecting the dignity and humanity of others.

Cancellation of the course must be made a minimum of 1 business day prior to the start of the second live virtual classroom session to be eligible for a full refund. Cancellations made on or after the date of the second live virtual classroom session are not eligible for a refund. Written notice of cancellation shall be effective on the date the withdrawal is received by Thought Coach. Refunds will be made within 10 days following receipt of an approved cancellation or withdrawal request.

Thought Coach will offer credit for partial completion of a course. The number of hours awarded will depend on the number of hours of curriculum received. If you are interested in receiving partial credit for a course in which you are currently or were previously enrolled, please contact Julie Rice (info@thoughtcoach.com.au) no more than 30 days after the course has ended. Please include details about the course in which you were enrolled, the number of credit hours you are seeking, and any additional relevant information. If approved, you will receive a certificate of credit from Thought Coach indicating the number of training hours completed.

Course fees can be either paid in full or instalments.

Where the Student has elected to pay the Course fees by instalments, the first instalment is due within 10 days of enrolment and the Student must continue to pay instalments as per their schedule. If any instalments are in default, your access to the Course may be suspended until such time as payment has been brought up to date.

Where the Student has elected to pay the Course Fees in full, fees are payable upon enrolment and must be paid in full no later than 10 days prior to commencement of training.

The Course fees and the Course selected is not transferable for any reason.

Payments are to be made by agreement in a supported currency (AUD, EUR, GBP, SGD, USD).

If you have completed a Level 1 program at another organization, we will apply your completed credit hours to your Level 2 program. You must provide documentation of your Level 1 completion, including the organization, number of hours completed, completion certificate, and contact information for the organization or trainer. You may be asked for additional details or documentation on an as-needed basis. Please contact Julie Rice (info@thoughtcoach.com.au) for more information.
